1. Introduction and Acceptance

Welcome to SmartRecall ("SmartRecall", "we", "us", or "our"), an AI-powered learning service that turns your study materials into spaced-repetition flashcards and helps you review them using the SM-2 algorithm. SmartRecall is available as a web application at smartrecallai.com and as a native iOS app distributed through the Apple App Store.

By creating an account, accessing, or using SmartRecall on any platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the service.

2. Description of the Service

SmartRecall lets you:

  • Create decks of flashcards, either manually or by uploading study materials (such as notes, textbook excerpts, or other text-based content) for AI-assisted flashcard generation.
  • Review flashcards with an implementation of the SM-2 spaced-repetition scheduling algorithm.
  • Sync your decks, flashcards, and review history across web and iOS via your SmartRecall account.
  • Purchase credits that are consumed when you use AI-powered features such as flashcard generation.

AI-assisted flashcard generation is performed by sending your submitted content to our AI routing partner (OpenRouter) and, through it, to downstream large-language-model providers (see our Privacy Policy). AI output is generated automatically and is provided for study assistance only — it may contain errors, omissions, or inaccuracies, and you are responsible for verifying correctness before relying on it for exams, certifications, professional decisions, or any other purpose.

3. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use SmartRecall. If you are under the age of majority in your jurisdiction, you may only use the service with the consent of a parent or legal guardian. By using SmartRecall, you represent that you meet these requirements.

4. Accounts

  1. Account creation. You may register with an email address, or via third-party sign-in (Sign in with Apple, Google, or GitHub). Information you provide during registration must be accurate.
  2. Account security. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized access.
  3. One account per person. You may not share, transfer, or sell your account. Automated account creation is prohibited.
  4. Deletion. You may delete your account at any time from in-app settings (iOS: Settings → Account → Delete Account; Web: Settings → Account). Deletion is permanent and removes your decks, flashcards, review history, and uploaded materials. Some information may be retained where required by law or for legitimate operational purposes (e.g., billing records).

5. Your Content

"User Content" means any study materials, notes, deck names, flashcard text, images, or other content you upload, create, or save in SmartRecall.

  1. Ownership. You retain ownership of your User Content.
  2. Your representations. You represent that you have the right to upload and process your User Content, and that it does not infringe any third party's copyright, trademark, privacy, or other rights. Do not upload copyrighted textbooks, exam papers, or other materials you do not have permission to use.
  3. License you grant us. You grant SmartRecall a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, and display your User Content solely to the extent necessary to operate, improve, and secure the service — including sending relevant excerpts to third-party AI providers to generate flashcards on your behalf.
  4. AI-generated output. Flashcards and other outputs generated by the AI from your User Content ("Generated Content") are provided to you for your personal study use. To the maximum extent permitted by law, you may use Generated Content for any lawful purpose. You understand that (a) identical or similar Generated Content may be produced for other users whose inputs happen to overlap, and (b) Generated Content is not a substitute for professional advice.

6. Acceptable Use

You agree not to:

  • Upload content that is illegal, infringing, defamatory, hateful, sexually explicit involving minors, or designed to harass others.
  • Attempt to access, probe, or disrupt the service, its infrastructure, other users' accounts, or AI provider endpoints in any unauthorized way.
  • Reverse engineer, decompile, scrape, or systematically copy the service except as expressly permitted by law.
  • Resell, sublicense, or commercially exploit the service, its AI output capacity, or the credits you purchase.
  • Use the service to generate content that violates applicable law, the policies of our AI providers, or the Apple App Store Guidelines (for iOS users).
  • Submit prompts, jailbreaks, or instructions intended to manipulate the AI into producing disallowed content.
  • Create automated accounts, use bots to consume credits, or otherwise abuse rate limits or fair-use mechanics.

We may remove content, suspend features, or terminate accounts that violate this section.

7. Credits, Purchases, and Payments

SmartRecall uses a credit system for AI-powered features. Credit bundles and subscriptions may be purchased through:

  • Web (smartrecallai.com): via our payment processors Stripe or Creem (both PCI-DSS compliant). Pricing, currency, and the active processor are shown in the checkout flow before you confirm payment. Your card details are submitted directly to the processor and are never stored on our servers.
  • iOS app: via Apple's in-app purchase system (StoreKit). All iOS purchases are billed by Apple under their terms; Apple's receipt is the authoritative record of the transaction.

Credits are non-transferable between accounts and have no cash value. Unless explicitly stated, purchased credits do not expire, but we reserve the right to introduce reasonable expiration policies with advance notice.

iOS subscriptions (if offered) auto-renew through your Apple ID until cancelled. You can manage or cancel renewals in iOS Settings → [Your Name] → Subscriptions. Cancellation takes effect at the end of the current billing period.

8. Refunds

  • iOS purchases are handled entirely by Apple and are subject to Apple's refund policy. Please request refunds for iOS purchases through reportaproblem.apple.com.
  • Web purchases via Stripe or Creem may be refunded under the conditions detailed in our Refund Policy. Contact [email protected] to request a refund.
  • Credits already consumed by AI generation are generally non-refundable because the underlying AI provider cost has already been incurred. See the Refund Policy for full details.

9. Our Intellectual Property

The SmartRecall software, brand, logos, user interface, design, code, the SM-2 scheduling implementation, and all documentation are owned by SmartRecall and protected by copyright, trademark, and other laws. Except for the rights expressly granted to you to use the service, no other rights are granted. You may not use the SmartRecall name or logos without our prior written permission.

10. Third-Party Services

SmartRecall integrates with third-party services, including but not limited to Apple (Sign in with Apple, App Store, StoreKit), Google, GitHub, Stripe, Creem, OpenRouter (which routes inference requests to downstream large-language-model providers for flashcard generation), Cloudflare (hosting, edge infrastructure, and R2 object storage for uploaded files), and PostHog (product analytics). Your use of those services through SmartRecall is subject to their respective terms and privacy policies.

11. Service Availability

We aim to keep SmartRecall available 24/7 but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service at any time, including for maintenance, updates, security, or legal reasons. We will try to give reasonable advance notice of material changes where practical.

12. Termination

You may stop using SmartRecall and delete your account at any time. We may suspend or terminate your account without notice if we reasonably believe you have violated these Terms, are putting the service or other users at risk, or are using the service in a way that exposes us to legal liability. On termination, your right to use the service ends immediately; sections 5 (license you granted), 9, 13, 14, 15, and 16 survive.

13. Disclaimer of Warranties

The service, including any AI-generated output, is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that AI-generated flashcards are accurate, complete, up-to-date, or appropriate for any specific exam, certification, or professional purpose. Do not rely on SmartRecall as the sole source for high-stakes decisions.

14. Limitation of Liability

To the maximum extent permitted by law, SmartRecall and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or lost study time, arising out of or in connection with your use of the service. Our total aggregate liability for any claim arising out of these Terms or the service will not exceed the greater of (a) the amount you paid to SmartRecall in the 12 months preceding the event giving rise to the claim, or (b) USD 50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless SmartRecall and its affiliates from any claim, demand, loss, or expense (including reasonable legal fees) arising out of (a) your User Content, (b) your violation of these Terms, or (c) your violation of any third party right, including intellectual property or privacy rights.

16. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which the SmartRecall operator is established, without regard to conflict-of-law rules. To the extent permitted by law, any dispute arising from these Terms or your use of the service will be resolved in the courts of that jurisdiction. Nothing in these Terms affects mandatory consumer rights you may have under the laws of your country of residence.

For users in the European Economic Area or the United Kingdom, you may also contact your local consumer protection authority, and the European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.

17. Apple App Store Additional Terms

If you downloaded SmartRecall from the Apple App Store, the following also apply:

  • These Terms are concluded between you and SmartRecall, not Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to furnish maintenance or support for the app.
  • In the event of a failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the app. To the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • You must comply with the Apple Media Services Terms and the App Store Terms of Use.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in-app, by email, or by posting a notice on our website, and we will update the "Last updated" date above. Your continued use of SmartRecall after the updated Terms become effective constitutes acceptance.
